Terms of Service

By accessing or using Poko Motion and related services (the "Service"), operated by Poko ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Poko Motion is an AI-powered desktop application for creating motion videos. You can provide source materials such as project repositories, websites, PDFs, and PowerPoint files, and the Service uses an AI agent to help generate scenes, narration, and edits. You can refine videos through natural-language chat and render exports on your local machine. The Service may also include a web dashboard for account management, billing, sharing, and optional cloud sync.

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Service. By using Poko, you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

You retain ownership of all content you provide to the Service ("User Content"), including source files, URLs, documents, media, and exported videos. By providing User Content, you grant us a limited, non-exclusive, worldwide license to process, transform, and store your content solely to provide and improve the Service (including optional cloud sync and sharing features you enable).

You represent that you have all necessary rights to any content you provide - including rights to websites, repositories, documents, trademarks, and likenesses depicted in your videos - and that your content does not violate any third-party rights or applicable law.

The Service uses artificial intelligence to generate, edit, and enhance video content, scripts, layouts, and narration. AI outputs may be inaccurate, incomplete, or unsuitable for your use case. You are responsible for reviewing all AI-generated content before publishing or distributing it. We make no guarantees regarding the accuracy, quality, legality, or fitness of AI-generated outputs.

If you use Bring Your Own Key (BYOK), AI requests may be sent to your chosen provider under your account and subject to that provider's terms. You are responsible for your API usage and charges from that provider.

You agree not to:

• Use the Service for any unlawful purpose or to violate any applicable law
• Upload content that infringes intellectual property rights of others
• Use voice or narration features to impersonate others without their explicit consent
• Scrape, crawl, or access third-party websites or repos in violation of their terms or applicable law when using URL- or repo-based features
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Use automated means to access the Service except through our provided APIs
• Upload malicious content, malware, or content depicting illegal activity

The Service, including all software, design, text, graphics, and AI models, is owned by Poko and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

Certain features require a paid plan, including subscription tiers and lifetime (LTD) purchases. Pricing, included AI credits, billing cycles, and payment terms are presented at checkout. Payments are processed by Stripe or Dodo, depending on the product. AI usage may consume included credits or top-up balance according to your plan.

We offer refunds within 7 days of purchase for genuine cases, at our reasonable discretion. Any AI usage incurred (including credits consumed and top-up balance used) may be deducted from the refunded amount. Beyond this window, and except where required by applicable law, fees are non-refundable. Promotional or partner pricing (including coupon codes and affiliate offers) is subject to the terms shown at the time of purchase.

The desktop application renders videos on your device. You are responsible for providing compatible hardware, operating system, disk space, and network connectivity. Render times and outcomes depend on your machine and project complexity. We do not guarantee uninterrupted local rendering or compatibility with every system configuration.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time. Provisions that by their nature should survive termination will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Poko and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
