Poko ("we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use Poko Motion and related services - including our desktop application, website, dashboard, and billing tools (collectively, the "Service"). Please read this policy carefully. By using the Service, you consent to the practices described herein.

Account Information

When you create an account, we collect information provided by your authentication provider (e.g., name, email address, profile picture). Account authentication is managed by Clerk, a third-party identity provider.

User Content & Source Materials

We collect and process content you provide to create videos, including project files, website URLs, PDFs, PowerPoint decks, images, brand assets, narration audio, exported videos, and related project data. If you use optional features such as AI narration or voice-related tools, we may also process voice samples you provide.

Desktop App & Local Processing

Poko Motion renders videos on your device. Source materials and rendered outputs may be stored locally on your computer as part of normal app operation. When you sign in and use cloud features (such as syncing projects or sharing videos), selected data may also be stored on our servers as described below.

Usage Data

We automatically collect information about how you interact with the Service, including: pages visited, features used, session duration, device information (browser type, operating system), and IP address.

AI Interaction Data

We collect the prompts, instructions, and project context you provide to our AI agent (including chat-based edit requests), along with corresponding AI-generated outputs and usage metadata (such as token usage for billing), to provide and improve the Service. If you enable Bring Your Own Key (BYOK), AI requests may go directly to your chosen provider using your API credentials instead of our proxy.

Affiliate & Referral Data

If you arrive via a referral link, we may store an affiliate identifier in a cookie (for example, poko_via) to attribute signups or purchases to the referring partner. See Section 9 for more on cookies.

We use the information we collect to:

• Provide, operate, and maintain the Service, including the desktop app and web dashboard
• Generate and edit motion videos from your source materials using AI tools
• Process payments, subscriptions, lifetime deals, and usage-based AI credits
• Store, sync, and deliver your projects and exported videos when you use cloud features
• Authenticate your identity and manage your account
• Attribute referrals and affiliate conversions where applicable
• Communicate with you about the Service, updates, and support requests
• Improve and optimize the Service, including reliability and AI workflows
• Detect, prevent, and address fraud, abuse, or technical issues
• Comply with legal obligations

We use trusted third-party services to operate the platform. These providers have access to your information only to perform tasks on our behalf and are obligated to protect it:

• Clerk - Authentication and user management
• Stripe / Dodo Payments - Payment processing for subscriptions and lifetime purchases
• Amazon Web Services (AWS) - Cloud infrastructure and database storage
• Bunny CDN - Media file storage and content delivery
• Anthropic - AI agent and editing (via our proxy or your BYOK credentials)
• OpenAI - Optional AI models when selected or configured
• Google (Gemini) - Optional AI analysis and processing
• Mixpanel - Product analytics
• Rollbar - Error monitoring
• Crisp - Customer support chat

Each of these providers has their own privacy policies governing how they handle data.

Your data is stored on secure servers provided by Amazon Web Services. We implement industry-standard security measures, including encryption in transit (TLS) and access controls, to protect your information. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

We retain your account data and User Content for as long as your account is active or as needed to provide the Service. If you delete your account, we will delete or anonymize your personal data within 30 days, except where retention is required by law or for legitimate business purposes (e.g., resolving disputes).

If you use AI narration, text-to-speech, or related voice features, we process the text and audio data needed to generate narration for your videos. Voice samples you voluntarily provide are used only to deliver those features. We do not use your voice data to train general-purpose models or share it with third parties except as necessary to provide the requested feature.

Depending on your jurisdiction, you may have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your personal data
• Object to or restrict processing of your data
• Export your data in a portable format
• Withdraw consent at any time (where processing is based on consent)

We use essential cookies to maintain your session and authentication state. We may use referral cookies (such as poko_via) to attribute affiliate conversions. We may also use analytics tools to understand how the Service is used. You can control cookie preferences through your browser settings where applicable.

The Service is not intended for users under the age of 18. We do not knowingly collect personal data from children. If we become aware that we have collected data from a child without parental consent, we will take steps to delete that information promptly.

Your information may be transferred to and processed in countries other than your country of residence, including the United States. These countries may have different data protection laws. By using the Service, you consent to such transfers. We take appropriate safeguards to ensure your data is treated securely.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page with a new effective date. Your continued use of the Service after changes take effect constitutes acceptance of the updated policy.
